Developing a Timber Sale Contract

Many landowners don't think about their woods on a day-to-day basis, except to enjoy the privacy scenery, and tranquil environment to live in and raise a family. However, something may trigger a need to make a decision about managing your woods. This decision point may come in the form of a logger knocking on the door asking to purchase your timber; or it may come from a need for income. If you decide to proceed with a timber harvest, it is ALWAYS advisable to have a written contract. A strong contract that represents your interests is a critical part of making sure YOUR goals and legal obligations are met. Since the goals of landowners, foresters, and loggers may vary, it is difficult to offer an example of one single contract that may be applicable in all circumstances. Nevertheless, there are common elements of a contract that are always advisable, and may be fine-tuned to fit certain circumstances.

• Units of Measure
• Price and Payment Schedule
• Performance Bond
• Insurance
• Harvest Tree Designation
• Harvest Map
• Landing
• Conditions of Roads and Landings
• Regulatory Responsibilities, including the protection of wetland resource areas
• Slash height and location
• Penalties of Cutting Unmarked Trees
• Improvements to the Woodlot, including gates, roads and bridges
